If you do not agree to any changes, you must immediately stop using the Site.

2. Use of the Site

Vivvi And Bloom® grants you a limited, revocable, non-transferable license to access and make personal use of the Site. You are not allowed to download or modify it in any way.

The Site is intended for informational and shopping purposes only. You may browse the Site and purchase Vivvi And Bloom® products as described herein. You may not use the Site for any other purpose without express advance written permission from Vivvi And Bloom®.

Any use or access to the Site not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark and other laws.

3. Your Account

You may be required to register and create an account to purchase products or access certain features of the Site. When you register, you agree to provide accurate, current and complete account information.

It is your responsibility to ensure your account information is accurate and up-to-date. If you discover that your account information is incorrect, incomplete or not current, you must promptly update your account.

You are solely responsible for any activity on your account, whether authorized by you or not. Vivvi And Bloom® is not liable for any loss or damage arising from unauthorized use of your account. However, you must notify Vivvi And Bloom® promptly if you suspect unauthorized use so steps can be taken to secure your account.

Your account is not transferable or assignable. You must keep your password secret and take steps to prevent unauthorized access to your account.

Vivvi And Bloom® reserves the right to terminate any account at any time for any reason. You are solely responsible for backing up or exporting your account content. Upon termination, your account and all account content may be irretrievably deleted.

4. User Content

Users of the Site may have the ability to post content, including reviews, comments and other material (“User Content”). You are solely responsible for your User Content.

By posting User Content, you grant Vivvi And Bloom® a perpetual, non-exclusive, royalty-free, irrevocable, worldwide and transferable license to use, reproduce, distribute, modify, publish and translate the User Content for any purpose.

Users are prohibited from posting any unlawful, threatening, defamatory, obscene, pornographic or profane User Content. We reserve the right to remove any User Content at any time for any reason.

The following terms constitute Vivvi And Bloom®’s “Content Guidelines”:

User Content cannot be defamatory, unlawfully threatening or harassing.

User Content cannot advocate illegal activity or discuss illegal activities with the intent to commit them.
User Content cannot offer or disseminate fraudulent goods, services, schemes or promotions.
User Content cannot provide material support or resources to any organization designated by the United States as a foreign terrorist organization.
User Content cannot impersonate anyone or provide inaccurate biographical information.

We reserve the right to remove any User Content that violates the Content Guidelines or is otherwise objectionable. You understand that when using the Site you may be exposed to User Content that is inaccurate, objectionable or otherwise inappropriate.

6. Orders and Payment

To purchase a product on the Site, you must be at least 18 years of age. Products may only be shipped to a valid shipping address provided with your order.

Applicable taxes will be calculated at checkout and added to your total purchase price, based on the shipping address and billing information you provide. You are solely responsible for payment of all applicable taxes.

We process payments through secure third-party payment processors. We cannot guarantee the availability of any payment method and may change available payment methods at any time without notice.

All purchase prices and other costs described on the Site are quoted in U.S. dollars. We reserve the right to change prices at any time without notice. Price changes will not affect orders that have already been accepted and confirmed by Vivvi And Bloom®.

We reserve the right to refuse service, reject or cancel any order, or discontinue any product at any time for any reason. We may require additional information from you prior to fulfilling an order. If your order is canceled or rejected, we will provide you with the reason for such cancellation or rejection.

No Vivvi And Bloom® employee or agent has the authority to vary these Terms.

7. Shipping and Delivery

We will arrange for shipment of your order to the shipping address designated by you at checkout. Please make sure your shipping address is complete and accurate to avoid delays. Shipping costs and delivery estimates are displayed on the checkout page.

We ship only to valid addresses within the United States, excluding territories. We are unfortunately unable to ship outside the United States at this time.

Title and risk of loss pass to you upon our transfer of the order to the carrier. Shipping dates on the Site are estimates only – your order will be shipped within the timeframe specified during checkout. We will notify you of any material delays.

You must inspect all packages upon delivery and notify us within 48 hours of any shipping damage or errors. We are not liable for any damage or losses caused by the carrier. Damage claims must be filed directly with the carrier.

8. Returns and Refunds

If you are not completely satisfied with your Vivvi And Bloom® purchase, you can return it for a full refund within 30 days of delivery.

To be eligible for a return, products must be unused, unaltered and in resellable condition with original tags and packaging. Unfortunately, we cannot accept returns on stained or soiled baby products for health and sanitary reasons.

To return a product, please email [email protected] to obtain a Return Merchandise Authorization (RMA) number. Your RMA number will be active for 15 days. Once you obtain an RMA number, securely package the product, write the RMA number on the outside of the package and ship it with a carrier of your choice to:

You are responsible for all shipping and insurance costs for returns. We recommend you select a shipping service with tracking capabilities and purchase sufficient insurance to cover the value of your return in case of loss in transit.

Upon receiving your return at our distribution center and inspecting it to confirm unused condition, your refund will be processed and a credit will be automatically applied to the original form of payment within 3 to 5 business days.

We reserve the right to refuse returns or exchanges that do not comply with these Terms. Unfortunately, we cannot process returns or exchanges after 30 days from your original delivery date.

9. Intellectual Property Rights

Vivvi And Bloom® retains ownership of all content on the Site, including logos, brand names, text, images, graphics, photographs, videos, page headers, custom graphics, button icons, scripts, website name and domain. All content is protected by U.S. and international copyright laws. The compilation, arrangement and display of content on the Site is our exclusive property and protected by U.S. and international copyright laws.

You may use content from the Site for non-commercial purposes only, provided you properly attribute it to Vivvi And Bloom®. Any other copying, distribution, reproduction, modification, display or transmission without the express written consent of Vivvi And Bloom® is strictly prohibited.

The names “Vivvi And Bloom®” and “vivvibloom.shop” and our logos are trademarks owned by Vivvi And Bloom®. The use of these marks in any way without our express written permission is prohibited.

15. Applicable Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules.

You expressly agree that exclusive jurisdiction for any dispute with Vivvi And Bloom® resides in the courts in Davidson County, Tennessee. You further agree and expressly consent to the exercise of personal jurisdiction in these courts.

16. Severability

If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions, which will remain in full force and effect.

17. No Waiver

No waiver of any term or breach of these Terms is effective unless in writing and signed by the party waiving such term or breach.
